Article 12 of the Turkish Penal Code, titled “crimes committed by foreigners,” stipulates that if a foreigner commits a crime that is detrimental to Türkiye and punishable by a minimum of one year of imprisonment according to Turkish laws in a foreign country, and if the offender is found in Türkiye, they will be prosecuted according to Turkish laws.
Furthermore, as mentioned above, if the crime is committed against a Turkish citizen or a legal entity established according to Turkish laws and the perpetrator is found in Türkiye, the perpetrator will be prosecuted according to Turkish laws upon the complaint of the victim, provided that no conviction has been made in a foreign country for that crime.
If the victim is a foreigner, the perpetrator can be prosecuted according to Turkish laws upon the request of the Minister of Justice if the conditions stipulated in the law are present.
